Police Background Investigations

Criminal Defense Investigation Services
If you are being questioned or investigated by police and have not yet been taken into custody, contact a lawyer immediately. Your lawyer can initiate a pre-charging investigation on your behalf. What this means is the attorney will obtain evidence and details from police and prosecutors who are conducting the investigation. It is very important that you do not talk to the police.

YOU HAVE THE RIGHT TO REMAIN SILENT AND NOT TO TALK TO THE POLICE.

Prosecutors and police can use your words against you. One major advantage of the pre-charging investigation is that your lawyer contacts the police for you, since nothing we say can be used against you. Please remember, the police are very good at getting people to talk. You will need an attorney to talk to investigators on your behalf, especially if you are NOT GUILTY of the charges.

Time is critical if you are being investigated and charges have not yet been filed. The best thing you can do is is contact a lawyer early in the process. Sometimes your criminal defense attorney can help prevent criminal charges from ever being filed in the first place.

If the police and District Attorney do not file criminal charges right away, (for various reasons) they are usually conducting a police investigation first. In pre-charging investigations, your lawyer can obtain evidence and present facts that might influence the prosecutor into not filing any misdemeanor or felony charges.

The main purposes of the pre-filing investigations are to advise you of your rights and to negotiate with police and prosecutors. It is also a way of showing the prosecution that they have a weak case, therefore not worth pursuing. You would you be spared the emotional and financial toll of prosecution.
