Sexual Assault Defined
Sexual assault is in most U.S. states includes any type of forcible and unwanted physical contact with any sexual organs (contact with penis, vagina, etc..). In many states, this also includes aggressive sexually suggestive statements (not just physical contact).

Sex assault laws protect the victim who did not legally consent to physical and unwanted sexual contact (for example, said “No” ) or if the person is she is unable for whatever reasons of giving legal consent to sexual contact (for example intoxicated with alcohol, drugs, date rape drugs, or physically or mentally impaired).

Rape is defined as “Aggravated sexual abuse by force or threat“ (found in Federal Code § 2241 (a), Ch. 109A under 'Sexual Abuse')

    'Whoever, in the special maritime and territorial jurisdiction of the United States or in a Federal prison, knowingly causes another person to engage in a sexual act-
      1) by using force against that other person; or
      2) by threatening or placing that other person in fear that any person will be subjected to death, serious bodily injury or kidnapping;
    -or attempts to do so, shall be fined under this title, imprisoned for any term of years or life, or both.'‘


Sexual assault or rape (sometimes used interchangeably) can be defined as physical, verbal, or visual abuse that forces a person to consent to sexual contact or attention. Can be committed by a family member, stranger, famous person or respected community member.

Forcible Rape or sexual assault is a crime that most often involves a female victim, and a male attacker. However, men and boys are also assaulted sexually. The sex assault victim is not responsible for the attack, regardless of the circumstances of the sex assault or rape (it does not matter what the person was wearing, where they were going, what they were doing or who they were with).

Rape and sex assault is most commonly committed by someone familiar to the victim (60% of all victims know their offender). Date or acquaitance rape is one of the most common forms of rape or sex assault.
